The following Conditions of Sale are considered part of the (“Terms” or the “Agreement”) of this Site. By visiting, using and registering in the Site, logging in or out of the Site, making any purchases, participating in any auctions, and/or using any social networking capabilities through the Site (individually and collectively, the “Service”) you are accepting and agreeing to be bound by each of the Terms set forth herein, including the Conditions of sale.

ORDERS AND PAYMENT

In the event you make a purchase (whether of products, gift cards or other) using the Site, you will be required to provide Flechada with your credit card billing information. You agree to pay for all charges accumulated by you on the Site. You acknowledge that you will have sole responsibility for all taxes relating to such order if applicable.

Any store credit(s) in your account will be applied first when you make a purchase. If a transaction exceeds the value or remaining balance of your store credit(s), the balance of the purchase price must be paid by you.

You agree that in the event Flechada is unable to collect the fees you owe Flechada, Flechada may take any steps it deems necessary to collect such fees from you, and that you will be responsible for all costs and expenses incurred in connection with such collection activity, including collection fees, court costs and attorneys’ fees. You further agree that Flechada may collect interest at the lesser of one and a half percent (1.5%) per month or the highest amount permitted by law on any amounts not paid when due.

The information on this Site does not constitute a binding offer to sell products described on the Site. We reserve the right at any time after receipt of your order to accept or decline your order, or any portion thereof, in our sole discretion, even after your receipt of an order confirmation or after your credit card has been charged. The prices displayed on the Site are quoted in United States dollars and are intended to be valid and effective only in the United States. In the event a product is listed at an incorrect price, we have the right to refuse or cancel orders placed for the product listed at the incorrect price, regardless of whether the order has been confirmed or your credit card charged. If your credit card has already been charged for the purchase and your order is canceled by us, we will issue a credit to your credit card account. Flechada reserves the right to limit the quantities of specific products a User may purchase.

Flechada will use commercially reasonable efforts to deliver items as quickly as possible and within any time periods indicated, but does not guarantee delivery and shall in no way be liable or responsible for any delivery not made within such time period. Also, Flechada Terms and Conditions of Use will not be liable or responsible for the character, quality performance, quantiy, size, color, merchantability quality, or fitness for a particular purpose of any product acquired by you or on your behalf from Flechada. The warranty coverage for a product will be limited to the coverage offered by the manufacturer of the product, if any.

In order to protect you and Flechada from fraudulent transactions, you agree that Flechada may provide your transaction-related information to a reputable third party organization to perform a verification of address. This verification of address is intended to ensure that the "bill to" address that you provide matches your credit card address. Flechada also reserves the right, at its discretion, not to ship items ordered or purchased on the Site to certain addresses. If Flechada chooses not to ship an item, you will be notified and any charges to your credit card will be reversed, canceled, or refunded, as applicable for products we do not ship. Flechada reserves the right to co-operate with local, state, provincial and national authorities in investigations of improper or unlawful activities and this may require the disclosure of personal information. We may also report to other organizations about improper or unlawful user activities and this reporting may include disclosure of personal information relating to those individuals conducting such improper or unlawful activities. In relation with the auctions, Users that bid on a specific auction and if such a bid results at the end of the auction time, to result of the winner, the member will be automatically charged on his/her credit card.
